1. Eligibility & Account Registration
You must be at least 13 years of age (or the minimum age required to form a binding contract in your jurisdiction, whichever is higher) to use the Service. By creating an account, you represent and warrant that you meet this requirement.
You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are solely responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.
You may not create more than one free account per person. Accounts created to circumvent a prior suspension or ban are prohibited and will be terminated.
2. User Responsibilities
You are solely and entirely responsible for all links, bio pages, QR codes, and any other content you create, publish, or distribute through the Service ("Your Content"). This responsibility includes:
- Ensuring that the destination URLs you shorten do not violate these Terms, applicable laws, or the rights of any third party.
- Ensuring that the content of any bio page or QR code you publish is accurate, lawful, and does not infringe any intellectual property rights.
- Keeping your destination URLs up to date and ensuring they continue to comply with these Terms for as long as your links remain active.
- Complying with the terms of service of any platform on which you deploy your Linkly links (including Instagram, TikTok, and similar social media platforms).
Linkly acts as a neutral technical intermediary. We do not endorse, verify, or assume any responsibility for the content of destination URLs or bio pages created by users. The fact that a link can be shortened or a QR code can be generated does not constitute our approval of the destination content.
3. Prohibited Content & Uses
You agree not to use the Service to create, distribute, or promote any of the following:
3.1 Illegal Activity
- Links to content that is illegal in the jurisdiction of the link creator or intended audience, including but not limited to content facilitating fraud, money laundering, drug trafficking, weapons sales, or the provision of counterfeit goods.
- Content that violates any applicable local, national, or international law or regulation.
- Links designed to circumvent geo-restriction controls imposed by law.
3.2 Spam & Unsolicited Communications
- Using Linkly links in unsolicited bulk email (spam), SMS spam, or any other form of unsolicited mass communication.
- Registering or using accounts in an automated fashion to generate large volumes of short links for spamming purposes.
- Disguising the true destination of a link to deceive recipients into clicking.
3.3 Phishing, Malware & Malicious Content
- Links to pages designed to steal credentials, personal information, or financial data (phishing).
- Links to malware, ransomware, spyware, adware, trojans, viruses, or any other malicious code.
- Links to pages that automatically download files to a visitor's device without their explicit consent.
- Links that exploit browser or operating system vulnerabilities.
3.4 Adult, Restricted & Harmful Content
- Links to pornographic, sexually explicit, or adult content, unless you operate a legally licensed adult platform and have received prior written approval from Linkly.
- Links to content that depicts, promotes, or glorifies self-harm, suicide, or eating disorders.
- Links to content involving the sexual exploitation or abuse of minors (CSAM). We are legally required to and will report such content to the relevant authorities without notice.
- Links to content that promotes hatred, discrimination, or violence based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
3.5 Intellectual Property Infringement
- Links to content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right of any third party.
- Using the Linkly brand, logo, or trademarks without our prior written permission.
- Creating bio pages that impersonate Linkly, its employees, or any other person or organisation in a way that is intended to mislead.
3.6 Platform Abuse
- Attempting to probe, scan, or test the vulnerability of the Service or bypass any security measures.
- Using automated scripts, bots, or scrapers to interact with the Service in a way that places an unreasonable load on our infrastructure.
- Reverse-engineering, decompiling, or disassembling any portion of the Service.
- Reselling or sub-licensing access to the Service without our written consent.
4. Content Ownership & License
You retain full ownership of all content you create through the Service, including your short links, bio page data, and QR code configurations.
By using the Service, you grant Linkly a limited, non-exclusive, royalty-free, worldwide license to store, host, display, and process Your Content solely as necessary to provide the Service to you. This license terminates when you delete the relevant content or close your account.
We do not claim any intellectual property rights over Your Content. We will not use your bio page content, link titles, or destination URLs for marketing purposes without your explicit consent.
5. Plans, Billing & Cancellation
Linkly offers both a free plan and paid subscription plans. Paid plans provide access to additional features as described on our pricing page.
- Billing cycle — Paid plans are billed monthly or annually, in advance, on the date you subscribed.
- Automatic renewal — Subscriptions renew automatically unless cancelled before the next billing date.
- Cancellation — You may cancel at any time from your dashboard. Access to paid features continues until the end of the current billing period. We do not offer prorated refunds for unused time unless required by applicable law.
- Refunds — Refund requests are reviewed on a case-by-case basis. To request a refund, contact [email protected] within 7 days of a charge.
- Price changes — We may change our pricing with 30 days' notice. You will be notified by email before any price change takes effect on your subscription.
- Free plan limits — We reserve the right to adjust free plan quotas (link count, click history, storage) at our discretion, with reasonable notice.
6. Abuse Reporting & Enforcement
If you encounter a Linkly link that you believe violates these Terms or applicable law, please report it using our abuse reporting form. Include the short link, a description of the violation, and any supporting evidence.
Upon receiving a report, we will:
- Review the reported link and destination content.
- Take appropriate action, which may include disabling the link, suspending the account, or referring the matter to law enforcement.
- Respond to the reporter within a reasonable timeframe where contact details are provided.
We have zero tolerance for child sexual abuse material (CSAM). Any link found to contain or direct to CSAM will be disabled immediately and reported to the National Center for Missing & Exploited Children (NCMEC) and relevant authorities without notice.
7. Account Suspension & Termination
7.1 Our Right to Act
Linkly reserves the absolute right, at our sole discretion, to:
- Disable any individual short link, QR code, or bio page that we determine, in our sole judgment, violates these Terms or poses a risk of harm — without prior notice and without liability.
- Suspend access to your account temporarily while an investigation is conducted.
- Permanently terminate your account and delete all associated data if you materially or repeatedly breach these Terms.
- Refuse service to any person or entity for any reason not prohibited by law.
7.2 No Prior Notice Required
While we will endeavour to provide notice of enforcement actions where practical and safe to do so, we are not obligated to provide advance notice before disabling content or suspending accounts, particularly where the violation involves illegal activity, phishing, malware, CSAM, or any other matter requiring immediate action to protect users or third parties.
7.3 Termination by You
You may terminate your account at any time by navigating to Settings → Delete Account. Upon termination, your account data will be permanently deleted within 30 days. Your short link codes will resolve to a 404 error page immediately after deletion.
7.4 Effect of Termination
Upon termination of your account for any reason: all licences granted to you under these Terms immediately terminate; your short links, bio pages, and QR codes will be deactivated; and we may delete all Your Content from our servers within 30 days. Billing records will be retained as required by law. Provisions of these Terms that by their nature should survive termination will do so, including Sections 4, 8, 9, 10, and 12.
8. Disclaimers & "As Is" Service
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
We specifically disclaim all warranties, including but not limited to:
- Availability & uptime — We do not guarantee that the Service will be available at any particular time or without interruption. Scheduled maintenance, infrastructure failures, or events outside our control may cause downtime. We provide no uptime SLA on the free plan.
- Data integrity — While we implement industry-standard backup practices, we are not liable for any loss of Your Content due to technical failures, corruption, or accidental deletion. You are encouraged to maintain your own records of important link destinations.
- Fitness for purpose — We do not warrant that the Service will meet your specific requirements or that any particular feature will remain available indefinitely.
- Third-party destinations — We have no control over and accept no responsibility for the content, availability, or practices of any destination website accessed via a short link created on our platform.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINKLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, or the cost of substitute services.
- Any damages arising from unauthorised access to or use of our servers or any personal information stored therein.
- Any damages arising from content published by third parties through the Service.
- Any loss or damage caused by events outside our reasonable control, including internet outages, natural disasters, or acts of government.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law.
In any case, our aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the greater of: (a) the total fees paid by you to Linkly in the twelve (12) months immediately preceding the claim; or (b) USD $50.
10. Indemnification
You agree to defend, indemnify, and hold harmless Linkly and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms;
- Your Content, including any claim that Your Content infringes, misappropriates, or violates any third-party right;
- Your use or misuse of the Service; or
- Any activity under your account, whether or not authorised by you.
11. Third-Party Links & Services
The Service integrates with or may link to third-party services (for example, payment processors, Google OAuth, and CDN providers). Your use of those third-party services is governed by their own terms of service and privacy policies. We are not responsible for the practices, content, or reliability of any third-party service.
12. Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable laws, without regard to conflicts of law principles.
Before initiating any formal dispute, you agree to first contact us at [email protected] and give us a reasonable opportunity (not less than 30 days) to resolve the issue informally.
If a dispute cannot be resolved informally, you and Linkly agree to submit to the exclusive jurisdiction of the competent courts in the jurisdiction in which Linkly is registered, except where applicable consumer protection laws in your jurisdiction grant you rights to proceed in your local courts.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:
- Update the "Last updated" date at the top of this page;
- For material changes, notify you by email at least 14 days before the changes take effect; and
- Display a notice in the dashboard for active users.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may close your account.
